ملخص:

تسعى الحزائر لتطبيقات التكنولوجيا المالية في البنوك الجرائرية العامة والخاصة بما يتناسب مع بناء القدرة التنافسية وتعزيز التجارة الخارجية، وقد هدفت هذه الدراسة لتقديم مقترح لتقنين استخدامات التكنولوجيا المالية في البنوك الجزائرية مراعيا اشباع الحاجات تبعا للتنظيم القانوني الدولي، اذ تظهر أهميته بتوضيح دور البنوك الجزائرية بعدم الاقتصار على الاتصاف بالتبعية المطلقة أو المروّج للتكنولوجيا المالية فقط بل باحداث التعديل بما يحقق اشباع حاجات الجزائر الحقيقية وحفظ الثروات، واتبع الباحث المنهج الاستقرائي الوصفي، وتوصلت النتائج لعوامل تقنن حاجات استخدامات التكنولوجيا المالية في البنوك الجزائرية تبعا لحالة وجود التنظيم القانوني الدولي الملزم والمرن أو عدم وجوده، ولذلك أوصى الباحث بالمقترح مراعيا اختلاف التنظيم القانوني لاستخدامات التكنولوجيا المالية وموضحا اثره في التعاقد واحتمالات دور البنوك الجزائرية في التعامل معه.

Abstract:

Algeria looking to apply financial technology in the Algerian public and private banks to build competitiveness and enhancing foreign trade. This study aimed to give a proposal to codify the needs of using financial technology in Algerian banks based to international legal regulation. The study importance appears by clarifying that Algerian banks should not be limited as an absolute dependency or a promoter of financial technology only, but to achieves the covering of Algeria’s real needs and the protection of wealth. The researcher followed the descriptive inductive approach. The results reached factors that codify the needs of financial technology using in Algerian banks depending on the existence of obligatory or flexible international legal regulation or not existence. Therefore, the researcher recommended the proposal, based to legal regulation differences of the financial technology uses and explaining its impact on contracting with possibility Algerian banks dealing with it.
